For the least developed countries, only 21 of the WTO`s 36 least developed members presented the names of Category B (Figure 2). Eleven of the 21 LDCs provided their indicative data, although this notification is not yet mandatory. It should be noted that the Democratic People`s Republic of Lao and Malawi are the only LDCs to have provided information on the operation of their single-desk systems (where distributors submit regulatory documents in one place). The TFA came into force on 22 February 2017, after two-thirds of WTO membership completed its ratification process on national territory. At the Bali Ministerial Conference in December 2013, WTO members reached a consensus on the Trade Facilitation Agreement (TFA). Eleven members (three developing countries and eight LDCs) were not appointed. In the two years since it came into force, 141 out of 164 countries have ratified the agreement, representing 86% of WTO membership (the TFA being applied on the basis of the most favoured nations). 12 of the other 22 countries are LDCs.

Nine countries have not ratified the TFA and have not communicated the commitments of Categories A, B and C. This means that the level of development can have a direct impact on the complexity of legal systems and on countries` ability to assess what they have to do, prompting donors and development partners to assist in legal processes. Developing countries had to notify the technical assistance necessary to implement their Category C denominations by 22 February 2017. Two years have passed and only 42 developing countries have provided all of this information (46% of the total number of WTO development members). LDCs don`t do any better. The deadline for the release of information on the necessary TACB expires today – 22 February 2019 – and only three LDCs (9% of the least developed wto members) have provided the necessary type of technical assistance.
