Another possibility is to make the subtenant pay directly to the landlord and inform the landlord of the sublease when the subtenant first pays the rent. If a lessor accepts a rental cheque from a subtenant without writing on the cheque “solely for use and occupancy”, the lessor cannot refuse the tenant the use of the apartment.23 The tenant (or sublandlord) is the person who rented the property to the lessor and now wishes to sublet the property to the subtenant. Part I entitled “Sublease” determines whether the landlord authorizes the tenant to sublet part of the entire land with or without the prior authorization of the subtenant.
